Animesh Maheshwari HUF (ARN-147412), an AMFI Registered Mutual Fund Distributor and SIF Distributor, treats the personal data of its investors, visitors, and staff as strictly confidential. This policy explains what data we collect, why we collect it, whom we share it with, how long we keep it, and what rights you have over it. It is framed under the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, the Prevention of Money Laundering Act, 2002, the SEBI Master Circular for Mutual Funds, and the AMFI Master Circular for Mutual Fund Distributors.

2. Scope

This policy applies to every person who interacts with us through our website, during onboarding, during Know Your Customer (KYC) verification, during risk profiling, and during the processing of mutual fund and SIF transactions. It also binds every person and vendor authorised to handle investor data on our behalf. By dealing with us or using our website, you accept the collection and use of your personal data as set out here.

3. Our Role Under the Act

Under the Digital Personal Data Protection Act, 2023, Animesh Maheshwari HUF is a Data Fiduciary. You are the Data Principal. Asset Management Companies (AMCs), Registrar and Transfer Agents (RTAs), KYC Registration Agencies (KRAs), and transaction platforms act as independent recipients or as processors, depending on the function they perform.

4. Data We Collect

Identity and Contact Data: Name, date of birth, PAN, Aadhaar (where the law requires it), postal address, mobile number, and email address.
Financial Data: Bank account particulars, annual income range, net worth range, existing investments, investment goals, investment horizon, and your responses to the risk profiling questionnaire.
Compliance Data: KYC documents, photograph, proof of address, FATCA and CRS self-certification, nomination details, and beneficial ownership details for non-individual investors.
Technical Data: IP address, browser type, device details, and cookie data when you visit our website.
Excluded Data: We do not collect data on religion, caste, political affiliation, health, or any other matter that has no bearing on mutual fund distribution or on our statutory obligations.

5. Why We Collect It

Your data is strictly used to:

Process your mutual fund and SIF transactions.
Complete KYC and meet obligations under SEBI, AMFI, and PMLA requirements.
Carry out risk profiling to check whether a scheme suits your recorded profile.
Send you transaction confirmations, statements, and service communications.
Answer your queries and handle your complaints.
Make statutory filings and maintain mandatory records.

We do not use your data for any other purpose.

6. Consent and Notice

We give you notice of the data we intend to collect and the purpose for it before or at the time of collection. Your consent is taken for each purpose and recorded. You may withdraw your consent at any time by writing to us. Withdrawal takes effect for the future, does not affect processing already completed, and does not override data we are required by law to retain. Where withdrawal prevents us from servicing your folio, we will inform you in writing.

7. Whom We Share It With

Data is shared exclusively with:

Asset Management Companies (AMCs) and their Registrar and Transfer Agents (RTAs) for transaction processing.
KYC Registration Agencies (KRAs) and the Central KYC Registry (CKYCR) for verification.
The exchange or industry transaction platform through which your order is routed.
SEBI, AMFI, the Financial Intelligence Unit (FIU-IND), and other authorities on lawful demand.
Auditors appointed by an Asset Management Company or by AMFI during due diligence or compliance review.

Zero Third-Party Sales Guarantee: We do not sell, rent, lease, or otherwise make available your personal or financial data to any marketing agency, advertising platform, or unrelated third party under any circumstances.

8. How We Protect It

Digital Records: Maintained on password-protected and access-controlled systems with licensed anti-virus software, security updates, and periodic backups.
Physical Records: Kept in locked storage at our registered office in Jaipur with restricted physical access.
Personnel Protocols: Access is strictly limited to authorized personnel who require it for their work. Every handler signs a confidentiality undertaking, and access rights are reviewed upon role changes or termination.

9. How Long We Keep It

Once the retention period ends, records are securely destroyed.

10. Your Rights

As a Data Principal, you hold the following rights:

Right to Access: Ask for a summary of the personal data we hold about you and processing carried out.
Right to Correction/Completion: Ask us to rectify inaccurate or incomplete data.
Right to Erasure: Ask us to erase data that is no longer needed for its original purpose and not required by law to be retained.
Right to Nominate: Nominate another person to exercise these rights on your behalf in the event of death or incapacity.
Right to Grievance Redressal: Raise a grievance regarding how your data is handled.

Requests are acted upon within a reasonable period, strictly within the timeframe prescribed under the Act.

11. Breach Reporting and Data Grievances

In the event of a personal data breach, we will report it to the Data Protection Board of India and inform affected investors within the prescribed period under the Act, detailing the nature of the breach and steps taken.
